Hello. At a 40 waist, you'd probably be in the 4XL range: 
This item is one of our few imported items so it runs a bit smaller than normal, but it still has a loose fit.
As an alternative, our Windproof Pants where an X-Large is designed for a 38-40 waist and a 36 inseam. This style also has a loose fit.
